TTK Services Pvt. Ltd. provides this service to you, subject to the following Terms of User Agreement ("TOU") that may be updated by us from time to time without notice to you. In addition to this, you shall be subject to the operating rules / policies applicable to the pricing plan and service you opted for at the time of placing a request or order on www. yourmaninindia.com.com which may be posted from time to time. TTK Services may also offer other services / plans on this website or different services on its other websites that are governed by different Terms of Service as may be applicable.

The terms, conditions and guidelines associated with use of the Services, the Site and any content (collectively, the "Content") available on the Site are set forth in this Terms of User Agreement ("TOU"). Please read this TOU carefully before you use the Services or the Site. By using the Services or the Site you ("you" or "your," or “Client” or “User” as appropriate) agree to abide by the terms, conditions, and guidelines set forth in this TOU.

Except as is provided in the YMII privacy policy, YMII Services reserve the rights, at any time, to modify, alter or update this TOU from time to time without prior notice. Such changes will be effective on the date that such modified TOU is posted on the Site, which is located at Terms of use. Use of the site or services after such changes have taken effect constitutes acceptance of all changes.

Please note that if YMII determines at any time that you have abused or violated any of these terms, conditions and guidelines, YMII reserves the right to terminate your access to the Site and Services immediately without notice.

By using the Website, you warrant that you have read and reviewed this TOU and that you agree to be bound by it. If you do not agree to be bound by this TOU, you may leave the Website immediately. YMII only agrees to provide use of this Website and Services to you if you assent to this TOU.

Affiliation:

YMII is an independent entity and is not affiliated with any government or government agency responsible for granting visa and/or work permits. Our services include providing immigration related services and visa services including guidance and concierge / associated services for immigration, for which we charge a service fee. We maintain the website yourmaninindia.com, which is a privately operated publication offering general information related to immigration and visas and services related to it. The information provided on our website should be used for reference purposes only and should not be considered a replacement for professional advice. YMII is not a law firm and does not offer legal advice or recommendations to its users. Any purchase of services made through this website are subject to the Terms of Use, and by using this site and making any purchase, you agree to be bound by these terms.

Eligibility:

The use of this Website and the Services is exclusively permitted for individuals who have the legal capacity to enter into binding contracts as per the applicable laws. Persons falling under the category of being "incompetent to contract" under the Indian Contract Act, 1872, as amended from time to time, including its reenactments, and those who are un-discharged insolvents, are not authorized to use the Website. If you are under the age of 18 years, you are explicitly prohibited from using, purchasing, or entering into contracts through this website. If you are registering as a business entity, you must ensure that you possess the necessary authority to legally bind the entity to this User Agreement.

Username, Password and Security

You are responsible for maintaining the confidentiality of your username, password or access OTP (one time password), and you are solely responsible for all activities that occur under your username and password. You are responsible for safeguarding and maintaining the confidentiality of your username and password and for any use of our Services with your username and password. You agree not to share your username or password with anyone. You agree to immediately notify YMII of any unauthorized use of your username and Password or any other breach of security related to the Site. YMII will not be liable for any loss or damage arising from your failure to adequately safeguard your username and/or password or to otherwise comply with this section.

Some of the links on the Site may allow you to leave ttkvisas.com website. Third-party sites to which the Site may link ("Third-Party Linked Sites") are not in any way under YMII’ control, and YMII does not assume any responsibility or liability for any information, content, communications, services, goods or other materials available on such third-party linked sites or for any changes or updates to such sites. YMII does not intend that such links contained on the Site to be referrals to, or endorsements of, any Third-Party Linked Site or the entities that operate them, and such links are provided for convenience only.

Requests & Orders 

Each request (Order) must be submitted by phone, email, chat or YMII website (www.ttkvisas.com). By placing an Order , you warrant that you are legally capable of entering into binding contracts.

E-visa:

  • The visa fee is subject to change and will be communicated at the time of application submission.
  • Visa processing may experience delays due to technical issues, changes in immigration process of government bodies, changes in embassy procedures with foreign missions, heavy rush of applications or other unforeseen challenges.
  • Visa may be refused or delayed if there is any misrepresentation or mismatch of information or documents provided at the time of filing.
  • Possession of a valid E Visa does not guarantee entry through immigration checkpoints. Immigration authorities will further verify the provided information before granting port of entry permission.
  • Visa issuance may be denied if the applicant holds a previous valid visa, has been deported, has overstayed a visa or for any other reasons which may not be disclosed by the competent authorities.
  • The visa will be valid only for the selected port of entry or airport as indicated in the application.
  • We shall not be held responsible for visa rejection or incorrect visa issuance in the case of application errors made by the applicant or any inadvertent errors while processing by the foreign missions.
  • The calculation of working days excludes weekends (Saturday and Sunday) and public holidays, and the processing duration may be extended at the discretion of the embassy or immigration authorities.
  • We reserve the right to decline the processing of any application.
  • Visa processing will commence only on receipt of full payment.
  • There is no direct point of contact within immigration to expedite the visa process, as the entire procedure is conducted online.
  • We neither claim nor can exert any influence whatsoever on any visa decision made by the foreign missions / embassies.

Visa:

  • The Embassy/ High Commission/Consulate General retains the right to request additional information and documents and YMII shall not be responsible or liable for any such requests.
  • Visa issuance is entirely at the discretion of the Visa officer, and YMII solely acts as a representative to facilitate services on behalf of the customer. The Visa officer may approve or deny the application for any reason, and the customer shall not have the right to make claims against YMII for such rejections or delays in approval by the Visa officer or by the competent authorities.
  • YMII is not responsible for any failures or delays in performance of its obligations caused by force majeure events, such as fog, earthquakes, floods, fires, riots, strikes, acts of terrorism, or circumstances beyond its control.
  • YMII bears no responsibility for delays in processing or decisions once the visa application has been submitted. In the event of a delay, you agree to adjust your travel plans accordingly.
  • Visa application fees are non-refundable and must be paid even if a visa is not granted and YMII shall not be liable for any refunds in such cases of denial or rejection.
  • As per the guidelines of the Embassy/ High Commission/ Consulate, an applicant must not overstay his / her visa validity. In the case of overstay, the individual will be fully liable for all legal obligations and penalties that may arise from time to time, including overstay penalties and YMII shall not be liable in any manner.
  • YMII neither claims nor can exert any influence in the visa decision-making process by foreign missions / embassies.

Travel Insurance:

  • YMII is responsible solely for facilitating the Travel Insurance policy chosen by the traveller from a preferred insurance provider on the basis of the information shared by the customer to obtain such policy for a specific country/geography of travel.
  • YMII requests you to carefully read the insurance policy and review the insurer’s terms & conditions to understand the inclusions and exclusions. Insurance products are obligations only of the Insurance company. YMII shall not be liable in any manner for the terms of offer from the insurance company and the acceptance of the same by the customer.
  • YMII holds no warranty and does not make any representation about the insurance, the quality of claims processing and shall not be responsible for claims, recovery of claims, or for processing of or clearing of claims by the Insurance company in any manner whatsoever.
  • Any claims related to the Travel Insurance policy will be exclusively handled by the Insurance company." Please refer your Travel Insurance Policy document for more information.

Account and Registration Obligations:

Your Information encompasses all data you provide to us during the registration, purchase, or in the feedback section, via email, written letters, or forms submitted to us. We will protect your Information in accordance with our Privacy Policy.

YMII does not wish to receive confidential, proprietary, or trade secret information via this Website, except for information related to your orders. Please be aware that any generic information, suggestions, ideas, or comments sent to YMII will be considered non-confidential. By submitting such information, you grant YMII an irrevocable and unrestricted license to use, modify, reproduce, transmit, display, and distribute such materials, information, suggestions, ideas, or comments for any purpose. However, we will not use your name or PII (Personally Identifiable Information) in connection with such materials, information, suggestions, ideas, or comments without your prior permission or unless required by law.

You also confirm and agree:

  • To provide accurate, current, and complete information about yourself as prompted by YMII Sign-up form or Applicant Details section (referred to as "Registration Data").
  • To promptly update the Registration Data to keep it accurate, current, and complete. If you provide false, inaccurate, incomplete, or outdated information or if YMII has reasonable grounds to suspect such inaccuracies, YMII reserves the right to indefinitely suspend or terminate your membership and deny access to the Website.
  • That in case of non-delivery of your documents due to your mistake (e.g., incorrect name or address), any additional costs incurred for redelivery will be your responsibility.
  • To use YMII' services for lawful purposes and comply with all applicable laws and regulations when using the Website and conducting transactions.
  • To provide genuine and accurate information whenever requested. YMII reserves the right to confirm and validate the information and details you provide at any time. If, upon verification, your details are found to be false, YMII has the discretion to reject your registration and prevent you from using YMII services or affiliated websites without prior notice.
  • That you are using the services on this Website at your own risk and exercising prudent judgment when entering into transactions.
  • That the delivery address for ordered services will be accurate and complete.
  • That you will carefully review service descriptions before placing an order and agree to be bound by the terms and conditions

Client Responsibilities and Obligations

  • The decision to book a service on YMII is entirely at the discretion of the customer.
  • In the case of joint or collective visa applications from a customer, it is understood and presumed that the authorized signatories have and undertake full responsibility on behalf of the remaining applicants.
  • YMII will offer guidance and advice to the respective applicant regarding the necessary documents to be submitted with their visa applications as per the guidelines provided by the relevant visa issuing authorities. Proper submission of the required documentary evidence for these services is at the sole discretion and responsibility of the respective applicants.
  • By accepting these terms and conditions, you authorize YMII to make payments on your behalf to the concerned embassy, consulate, visa processing authorities, or any other authorized third parties involved in the process.
  • Please note that YMII and its staff will assist in completing your application form based on the documents and information provided by you. Verification and authentication of the documents and details provided in the application form are entirely at your discretion and responsibility. By accepting all necessary terms and conditions, you agree to YMII submitting the application to the visa issuing authority on your behalf.
  • YMII and its staff are not responsible for the content and accuracy of the information provided in the application form. This responsibility solely rests with the applicant.
  • YMII and its staff will not be held responsible for any decisions made by the relevant visa issuing authorities regarding visa issuance. The decision lies entirely at the discretion of these authorities, based on the merits of the applicant's case.
  • Any quotation provided by YMII is valid only as per the validity specified in such offer.
  • Requirements and fees related to visa processing are subject to change without prior notice. These changes may include adjustments to embassy or consulate fees, processing times, procedures, application forms, and required documentation for visa issuance. YMII and its staff will not be held responsible for such changes, or any losses incurred by the applicant due to such delays or alterations.
  • The visa requirements and related information for each respective country are determined by the sovereign nation and are subject to change without prior notice. While YMII strives to provide current, comprehensive, and up-to-date information, it cannot guarantee that the information provided is always the most current and complete.
  • Appointments for collecting biometric data or self-submission of visa applications, as well as visa interview scheduling as a service, will only occur once the visa application is complete and verified by YMII. If an applicant requests YMII to reschedule an appointment before the scheduled dates for submitting this data for any of these services, YMII will make a reasonable attempt to reschedule the dates. However, YMII should not be held responsible for the completeness of the visa application. YMII reserves the right to charge separately for this service at any time.

Prohibited Uses

As a user of the Services or the Site, you agree to use the Services and the Site only for lawful purposes. Use of the Services or the Site for transmission, distribution, retrieval or storage of any information, data, or other material in violation of any applicable law or regulation is prohibited. You also agree not to use the Services or the Site to

  1. Use or transmit any material protected by copyright, trademark, trade secret, patent, or other intellectual property right without proper authorization;
  2. Harass others by “mail-bombing” or “news-bombing”;
  3. Threaten, harass, defame, embarrass, or distress any person or group;
  4. Distribute computer viruses, worms, or any software/s intended to damage or alter a computer system without the owner’s consent;
  5. Use “auto-responders,” “cancel-bots,” or other similar mechanisms that generate excessive network traffic;
  6. Post or send any unlawful, harmful, defamatory, slanderous, pornographic, obscene, vulgar or similarly tortuous or otherwise objectionable material;
  7. Post, send or relay any unsolicited advertising;
  8. Post or send any chain letters or pyramid schemes;
  9. Post or send any fraudulent or misleading offers of products, items, loans, or other services;
  10. Post any misleading, inaccurate or fraudulent information;
  11. Post any junk e-mails;
  12. Post any duplicative or unsolicited messages;
  13. Harvest or otherwise collect information about others, including e-mail addresses, without their specific consent;
  14. Create a false identity or forged e-mail address or header or otherwise attempt to mislead others as to the identity of the sender or the origin of the message;
  15. Attempt to gain unauthorized access to the Services, other accounts, computer systems or networks connected to the Site through login password mining or any other means.

Use of Client information, documents, property and materials

You may provide YMII with information and access to content, images and licensed software and equipment to enable us to provide services. YMII warrants that all your information, documents, property and materials will be used exclusively in connection with the performance of the Services under this TOU and not for any other purpose. It is the customer’s responsibility to inform YMII if any information shared needs to be treated as confidential and how to handle such information. You must ensure that the information or any property or materials provided by you does not violate any applicable laws or infringement of intellectual property rights.

If you recommend YMII to process any document on behalf of an applicant, then you are responsible to take appropriate consent before the YMII uses it to provide the required service. You must ensure that all appropriate Authorization/consent is procured to process such documents.

Service warranty

YMII is responsible for the quality of the work it delivers and commits to making all reasonable efforts to deliver quality deliverables, on a 'best-effort' basis only. YMII shall not be liable for any inability to deliver services as agreed that is attributable to reasons beyond its control.

Rates and Price Variations

YMII reserves the right to vary prices and rates in the event of changes in exchange rates or price rises. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you are required to pay the differential amount when notified by us or you may cancel the booking which may result in cancellation fees. We are not liable in any way if any increase occurs. Rates quoted are appropriate to the particular product at the time of quoting and these rates may change any time until the visa decision made by the competent authorities. All prices are subject to availability and can be withdrawn or varied without notice.

While providing visa or immigration-related services, YMII acts strictly as a facilitator, limited to the collection of applicable visa fees, service provider fees, and other related expenses, if any. YMII transparently forwards the collected fees along with the visa application to the respective country's embassy or its designated front office like VFS Global and/or its service providers. All professional / service fees collected by YMII are separately accounted for and indicated in its financial records.

Ownership of Intellectual property

YMII, along with its suppliers and licensors, expressly retain all intellectual property rights related to the text, programs, merchandise, processes, technology, content, and other materials featured on this Website. Accessing this Website does not grant, and should not be construed as granting, any individual a license to use YMII' or any third party's intellectual property rights. All rights, including copyright, associated with this website are either owned by YMII or licensed to YMII. Any utilization of this website or its contents, including copying, storing, or using them in whole or in part, for anything other than personal, non-commercial purposes, is strictly prohibited without obtaining prior permission from YMII. It is not permissible to modify, distribute, or re-publish any content from this website for any purpose.

The names, logos, merchandise, and service names, design marks, and slogans associated with YMII are the trademarks or service marks of TTK SERVICES PRIVATE LIMITED. Payment terms

Payment for services can be made online through various payment methods such as Visa, MasterCard, American Express cards, or online payment methods (UPI, for example).

All payment methods are subject to validation checks and authorization by your card issuer / bank / payment gateway / UPI or similar payment platforms. If we do not receive the required authorization for your payment, we will not be liable for any delay or non-delivery of your order.

All payments are subject to transaction charges as may be levied by the payment gateway on behalf of the card issuers / bank. Any service charges or prices quoted by YMII are exclusive of transaction charges.

Cancellation & Refund Policy

Cancellation Policy

You can cancel your Visa Application any time after placing a request with YMII. Applicable refund if any, on such cancelled requests will be subject to our Refund Policy.

Cancellation by YMII

YMII reserves the right to cancel any visa application before submitting it to Consulate or Embassy if it is found or suspected that the application or the documents submitted to us by the customer contains / may contain improper information, misrepresentation, fake, fraud or wrong information. We also reserve the right to refuse or cancel your application at any time for certain reasons including but not limited to:

  1. Downtime and unavailability of Embassy/third party systems to process your visa/s.
  2. Unavailability of authorization or certain restrictions on third party submission of visa applications that may be enforced by certain embassies.
  3. Or any other unavoidable or unforeseen circumstances including force majeure causes.

Cancellation by the Customer

Customer reserves the right to request for a cancellation of his/her application at any point of time due to cancellation / change of travel plans, medical reasons or for any reason whatsoever after placing a request. However, any refund applicable on such cancellation shall be subject to the Refund Policy.

Termination

This User Agreement remains in effect unless terminated by either you or YMII. You can terminate it by providing written notice through this website or e- mail, expressing your desire to disassociate from this website. To terminate, you must also cease any further usage of this Website. YMII retains the right to terminate this User Agreement at any time, with or without notice, immediately revoking your access to the Website. TTK Visa is not liable for any consequences arising from this termination. In the event of User Agreement termination, whether initiated by you or YMII, you must promptly delete all materials acquired or downloaded from this Website, along with any copies, whether obtained through the User Agreement or otherwise. YMII' entitlement to any comments or feedback provided shall persist after User Agreement termination. Such termination does not exempt you from any obligation to pay for the services already ordered from the Website or impact any liabilities that may have arisen under the User Agreement.

Sub-contracting

YMII shall be entitled to perform any of the obligations undertaken by it through its employee, associates, consultants or through suitably qualified and skilled sub-contractors/vendors. Any act or omission of such other associates or sub-contractor shall, for the purposes of the Agreement, be deemed to be an act or omission of YMII.

Other Client Responsibilities and Obligations

  • Restricted services: YMII employees are not permitted to support any illegal, unethical, fraud or misrepresentation while performing the required services.
  • You are strictly prohibited from using the Website or any of the Company’s Services for illegal spam activities, including gathering email addresses and personal information from others or sending any mass commercial emails.
  • Reverse Engineering & Security: You agree not to reverse engineer or attempt to reverse engineer or disassemble any code or software from or on the Website or Services. You agree not to violate the security of the Website or Services through any unauthorized access, circumvention of encryption or other security tools, data mining or interference to any host, user or network.
  • Breach of legislation/guidelines: YMII provides services to the Client as per the instructions received and it is the responsibility of the Client to collect necessary consent from the individuals whose information is disclosed to YMII. Under no circumstances shall YMII be liable for any breach arising due to the failure of obtaining consents from such other people, including third parties, as per the guidelines set in the applicable legislations like GDPR, CCPA or any other applicable legislations.
  • Violates any law for the time being in force.

Independent contractor

YMII is and will remain as an independent contractor in its relationship with Customer. Nothing in this TOU is intended to, or should be construed to create a partnership, agency or joint venture or employment relationship between YMII and Customer.

Force majeure

YMII will incur no liability to the Customer or be deemed to have defaulted under or breached this TOU for any failure or delay in its performance of any obligation under this TOU by causes beyond its control and without the fault or negligence of YMII. Causes (“Force majeure events”) beyond YMII control may include, but are not limited to, acts of God, flood, fire, earthquake, war, acts of terrorism, explosions, strikes, telecommunications breakdown, power outages or shortages, acts of governmental authorities such as changes in controlling law, regulations, orders or the requirements of any governmental entity, severe weather conditions, civil disorders, natural disasters, fire, pandemic and quarantines and general strikes in India.

Indemnity

You agree to indemnify, defend at your expense, and hold harmless YMII, its telecommunications providers and service providers and its subsidiaries, affiliates, officers, directors, employees, consultants and agents (if any), from all and any third-party claims, liability, damages and costs (including, but not limited to, attorneys' fees) arising from or relating to

  1. your use of the Services and/or the Site,
  2. any content you post, e-mail, transmit or relay either to YMII or by use of the Services or the Site,
  3. any negligence, or wilful misconduct by you, your employees, associates or representatives,
  4. your violation of the TOU, or
  5. your alleged infringement of any intellectual property, copyright, trade secrets, moral right or other proprietary right of any person or entity.

Limitation of liability

In no event shall YMII be liable for any indirect, incidental, special, or consequential losses and damages, or any punitive or exemplary damages arising out of or in any way connected with the services provided by YMII or arising from this TOU. Neither shall YMII be liable for any action taken or omitted by its employees in pursuance of this TOU in good faith, except for gross negligence, bad faith or wilful misconduct adjudicated by a court of competent jurisdiction. YMII’ obligation shall be restricted only to actual and direct losses and not to any indirect, special, or consequential losses. The services available on the site, any websites linked to the site, the materials or information contained at the Site, or the foregoing limitations of liability constitute a fundamental basis of this TOU and YMII would not have permitted you to use the site or the services absent such limitations.

In the event of a breach of this TOU by YMII, the aggregate, and cumulative liability for damages on all accounts resulting from this TOU hereunder shall in no event exceed the amount of service fees received from the Client against a particular service request or order.

The Company's sole responsibility is to process the visa application and fulfil the necessary formalities in accordance with the official rules, regulations, or statutes. The Company shall not be held responsible for any liability due to the approval or rejection of the visa by competent authorities for any reasons whatsoever, which impacts your travel plan.

The Company shall not assume any responsibility or liability in situations where you choose to overstay at a particular destination without the necessary approvals. In such instances, you shall be held responsible for any penalty charges, disciplinary actions, legal proceedings, or similar actions initiated by the government or relevant authorities.

Further documentation

If any other TOU or 'Service/Task request(s) or SLA are necessary to enforce the intent of this document, both parties agree to execute such provisions as and when the need arises.

Dispute resolution

Any disputes arising out of or in connection with the TOU shall be first attempted to be settled through discussion and negotiation between the heads of the respective organizations. If a settlement is not arrived at within thirty (30) days, the dispute shall be referred to an independent arbitrator who will be appointed by YMII and his/her decision shall be final and binding hereto Each party will bear their own cost of the arbitration. The number of arbitrators shall be one. The place of arbitration shall be Bangalore, India. The language used in the proceedings shall be English. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time.

Governing laws and jurisdiction 

All matters arising out of this TOU shall be governed by and construed and enforced in accordance with the laws of India, without giving effect to any choice of conflict of law, provision or rule that would cause the application of the laws of any jurisdiction other than those of India and the parties hereto agree to submit to the exclusive jurisdiction of the courts of Bangalore for any disputes arising out of the subject matter.

This Agreement is in person-to-person basis and is non-transferable, and you may not assign your rights or obligations to any third party on your behalf.

General Terms

If any provision(s) of the TOU is found to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. YMII’ failure to exercise or enforce any right or provision of the TOU shall not constitute a waiver of such right or provision. The TOU constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the TOU will be effective only if unambiguously made in writing and signed by YMII.

Acknowledgment

This TOU constitutes the entire understanding and agreement between Customer and YMII, and supersedes and cancels all prior agreements, understandings, and representations in their entirety and are of no further force and effect.

Signatures

This document is an electronic record in terms of Information Technology Act, 2000 and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000 and does not require any physical or digital signatures.
