Selling & Buying Assistance in Delhi and Bangalore to Person of Indian origin (PIO) in USA.

Krishna Prasad (name changed), a PIO aged about 65 years lives and runs an architect firm in the US for last 30 years. He visits India twice a year for about two to three weeks.

Prasad inherited an ancestral property in 2001 at Delhi after the demise of his aged father. He decided to dispose the property as he had no family or friends in Delhi. When he duly informed the tenants, who had inhabited the premises for over 10 years about his decision, they simply refused to vacate. They did everything possible to make it nearly impossible for Prasad to find a suitable buyer who would be interested in buying at the then, prevailing market rates. In fact, he had to employ a security agency to retain possession of the premises even when his father was alive and living there, simply because the tenants were taking undue advantage of Prasad's absence and his father's ailments.

Prasad couldn't spend time in India to resolve these matters and hence requested help from a friend in Delhi. After one and a half years of efforts and overcoming a lot of resistance, the friend found a willing buyer who was ready to buy the property at a discounted price on account of the illegal encroachments by the tenants.

Prasad, who had earlier on used YMI services for geriatric support to his aged father approached us again for help. We provided selling assistance through a Power of Attorney issued to us and assisted the friend in completing the sale transaction in Delhi without Prasad's presence. YMI also helped him with the
capital gains computation through a tax expert.

Happy with the assistance that was provided, he decided to take YMI's assistance with re-investing the sale proceeds in a place where he had other family interests; Bangalore. He contacted YMI and expressed his intention to purchase an apartment in a building with not more than three or four floors. But finding a suitable property from a reputed builder that wasn't a high rise structure and meeting all the required specifications was not an easy task. He was also apprehensive as he had no experience of purchasing a property in India, and was also unaware of the local rules and regulations. The bitter experience of the past with tenants in his ancestral property was also playing on his mind.

Two years later, after many accompanied visits with YMI to multiple properties during his infrequent visits to Bangalore, he finally invested in a plot at a residential resort complex cum golf course in Bangalore. YMI again, provided buying assistance on this purchase.

Prasad heard about retirement homes being developed by a Pune builder through his friends in the US and was interested in a similar project in Bangalore. He approached YMI for assistance and we helped him with the agreements, rate negotiations and coordinating EMI payments to the builder through post-dated cheques. We also coordinated with the builder to accommodate minor modifications in the apartment according to client's needs. Prasad was remotely managing the entire buying process through YMI while he was in the US concentrating on his work and family.

Unfortunately for Prasad, the project did not proceed as per schedule due to some clearance issues and unforeseen litigations. Due to the delay in completion, Prasad wanted to cancel his purchase and instructed YMI to coordinate with the builder and cancel the contract. YMI initiated this activity and successfully cancelled the contract as per terms & conditions. The builder refunded the amount paid with penalties as per terms of contract.

He wanted to re-invest this money in another residential apartment within CBD (Central Business District) of Bangalore. YMI worked closely with him and selected a residential CBD project of a reputed builder from among 5 short listed properties. We again provided buying assistance and negotiated the price on his behalf and a contract was signed towards purchase of the flat. YMI continues to coordinate with the builder for EMI payments and for all interior modifications in the flat. This property is slated for delivery in the first Quarter of 2008. YMI is expected to handle the sale registration through the POA issued by Prasad, when the project nears completion.

Over the years with active support from YMI, a confident Prasad is no longer apprehensive about his investments in India. During a recent visit to Bangalore he decided to purchase another apartment for investment purposes. Based on the current market conditions, a residential project developed by one of the leading builders was selected. YMI participated in the discussions and provided Prasad with vital information that was helpful in the decision making process. Now YMI takes care of the payments and interactions with the builder on behalf of Prasad.

Despite initial apprehensions and not being physically present in Bangalore, Prasad has now invested in no less than 4 properties in India using YMI's Property Management Services. Once he retires, he plans to spend a part of his time in India. He is confident about his plans for India.Prasad bought his peace of mind.
